Otacool 2. Copyrights issue.

Before you dwell into my take on Otacool 2, keep in mind that I am one biased fark. Although I try to make sure I sound as just as possible. I’m not. There’s a saying, “A Human’s heart were never in the center for a reason.” Cause humans will always be biased. One thing you can be sure of is that I’m honest. Hahaha… If you believe it. -.-”

*Feel free to skip this section if Tl:dr. But do spend some time on the next section which highlights a rather important issue.

I’m sure you guys have heard about Otacool 2 and all the sour sauce it’s dipped in. You can’t deny that having 22 females to 2 males on the cover is plain cheesy. Hmm… 2 males or 1 male. Actually, am I even suppose to include D.Choo as a cosplayer or not? Cause honestly, even his compadre the Gordonator has pointed out certain discrepancies. Now IF I were to agree with him, wouldn’t that just add to the question of why is D.Choo on the cover? Heck, the costume isn’t even that good when compared to other cosplayers.

So question 1, should D.Choo be on the cover of Otacool 2? Is he there as a cosplayer OR as a member of the staff/production team/etc.? From Kotobukiya, D.Choo is clearly there as a cosplayer. If so, then D.Choo is clearly a bad choice.


Even Shin-chan was a better choice if costuming was a green light. No?

Googling again and I came across Playboy Otacool 2, a post which touches briefly on a bit of the huh-hah doing on around Otacool 2.

Regarding the sexism going on in Otacool 2. I’m actually alright with it. I won’t deny that me being a guy find female cosplayers more alluring. This IS coming from a guy who loves his moe. So remember, I’m probably brainwashed; by the likes of KyoAni (Oh wait! Let’s not turn this into a KyoAni drama).

What I do NOT approve of is that why in the god damn world would you bother to include 2 male guys in the cover. And to have one be D.Choo himself. That’s absolute and undeniable self pimp-ation right there! I mean… Heck, I won’t buy the book, But I’d print out a cover of Otacool 2, stick it on a wall and play darts on it. D.Choo = 50 points!

Kaname is totally cool however. My take on him is that he is a good cosplayer, starting to get swallowed by pressure of worldwide exposure. Like how Danny was when he started aligning himself with big companies. Having to “clean up his act” and so forth. Just my impression. Not like I know the guy.

Question 2… Are you “o.k” with Otacool 2 cover featuring a 22 female to 2 male ratio? Is it some sick harem fantasy D.Choo is trying to create for himself. And let’s not kid ourselves, the inner pages of the book will probably have an even more staggering ratio.
You know what? Drop Danny Choo, put me on the cover instead. He has a wife. I’m the one who needs a harem, Damn it!

If you noticed, yeah… this is a post written with half-assed research. So don’t take my word for it, google it yourself. Get your own info. Then post your own take on this. And let me know when you do. Cause I’d love to get more feedback.

As Ninjovee mentioned, there just isn’t enough light shed on Otacool 2.

Again, I don’t actually hate D.Choo. In fact, I still admire him for opening countless possibilities for other bloggers whether it be on Japan, anime, figure or cosplay wise. But you can’t deny the dark waters surrounding this whole Otacool 2 and what dannychoo.com has become.

If any of you Kotobukiya or DC trolls are reading this… Yeap! I just helped you gain more coverage, so be grateful!

OK! My rants are done. My heart has settled. Time for the REAL issue here.

A fellow photographer recently brought this to my attention. Which later got me feeling stirred up. Enough to want to post my take on Otacool 2. Which resulted in the rant above. Lol. -.-”
But what he really wanted me to check out was the following…

First, do take a minute or so and read Garion’s take on the copyrights issue concerning Otacool 2. Now I don’t know much about laws or copyrights. But in “plain” English, if what Garion mentioned is true, Kotobukiya can help themselves to any submitted cosplay photographs for any advertising or promotional intentions. Without regards or even crediting the photographers.

Now my take on this is, if photographers do indeed maintain a certain right over their photos, which I believe they do, and Kotoblah’s terms stick as well, wouldn’t this leave the cosplayer in the middle totally farked up from both parties? Cause the cosplayer would be the one who “gave” the rights to Kotoblah.

Cosplayers would probably ask for the photographers consent before submitting any photos. And photographers will probably agree. Thinking “no harm done” and even hoping for a chance to get their work showcased. Heck, I’d let any cosplayers use my photo out of friendship or plain courtesy.

I, speaking as a photographer by hobby, am not looking to earn big money by taking royalty for my work or what not, instead, it would be more then enough if my work is recognized and properly credited. And I’m sure I’m not the only one who feels this way.

In the end, I hate one fact and one fact alone, and that is Kotoblah hiding the terms and conditions about it. Just make it clear!
Are you going to use it for advertising?
If you are, will there be any form of compensation for the involved parties?
If not monetary then at least credits or mentions where due?

Theeeeen cosplayer AND photographers can decide on their own whether if they want to submit their work. Even if the terms are disadvantageous to them. No complains then, seeing how everything will be in clear black and white. Not shady gray.

It’s a common practice among cut throat corporations, that I know. But I also know it is a common practice for people to rage on it when it is discovered. 😉

  1. I am sick of DC as of late. Thanks to OEG, I kinda realize how he’s making money for himself. So on the Otacool cover issue, I think that he SHOULDN’T be on the cover. I mean jeebus, why the fuck are you up there? You are NOT a cosplayer dammit!

    and I am pissed about the hidden T&C shit. That’s just so un-fucking-fair /rant.

    I kinda stopped reading OEG. Sometimes their words are so true it hurts. And sometimes I can’t even relate to what they are saying. But most of the time, I just can’t bring myself to reading too long of a post. Lol. But what they say about DC is solid.

    This just crossed my mind, but what if DC is swept under pressure by the corporations too. Is he somehow tied down by contracts or sort form of exchange and agreements done in the past.
    Is he willingly submitting himself to the firing squad under orders by bigger corporations, only being able to be a puppet?
    Or is this something he wanted to do himself, but failed to predict the trolls which would follow?
    Or was he able to predict the negativity it would receive, but just didn’t care?

    Lol. Just trying out the “other side” of the story.

    Still, the OTACOOL 2 cover and pulling one on the Terms and Conditions, on a worldwide scale…

      I don’t know how else to say this, but I honestly think that this is indeed the case. The reason might be because he wants to get an anime out of Mirai, and the apparent way to do so is to get chummy with those on top.

    And thus another hobbyist’s activity goes commercial… Well, somebody said once that Danny is first and foremost a businessman. Just from the cover, Otacool 2 is heavily commercialized – the industry mostly targets the male consumers, after all. I suppose he’s gotten so much scorn recently because he’s grown so big the fact that this is for the sake of revenue has become sorely apparent. I’m neutral when it comes to DC – I realize that’s how the guy wins his bread, and I won’t attack an internet superpower unless he crosses some personal line. I think I save myself from bursting a few veins that way. Hey, at least he was only one of the photos, and not half the page 😛
    And then, making the terms and conditions fine print is almost a corporate sleight of hand as well. T&C are a secret weapon nowadays.

    Kotoblah, lol.
    Well, don’t lose heart, blur! You’re a significant photographer, rally the cosplayers and fight for their rights!~

      In actuality, Danny is barely a blip on the big map of internet superpowers. It’s that map on Wired modeled after the Tokyo subway system. Good luck finding Danny’s name, if he’s even there at all. You’ll be surprised who shows up better on the map than him.

    in the cover some of them is just wrong and so do danny choo and those
    with a maid dress come on i dint get any feel that they are cosplay over there
    what this DC think he is cosplayer no he is just some one who wear a
    costume and just run here and there he not consider as a cosplayer
    so do the 2 maid COME ON !!! are you choosing a AV instead of cosplayer
    and there is many great cosplayer submit but those being choose yes some is nice
    but most of they choose because the girl was pretty or just become sexy
    they have no eye ah!!! want choose AV go away laaa~~~~ don’t misleading
    that cosplay is something that showing body or showoff please tell them to think carefully
    there many nice cosplayer can choose instead of those just being pretty or sexy

I mean, every once and a while I’ll go to his site, because he has some cool pictures, but why are there 100 comments under a post that is nothing more than a bowl or ramen?     A simple one liner ‘photographer by…’ isnt taking a lot of space in a page anyway

  8. I was talking about this issue with some people at Emina and CF the other day as well. In one hand, we don’t really care. We already know that this will happen in one way or another. First and foremost, the this is Kotobukiya’s work, just that they are collaborating (or more like leeching) with Danny Choo. As we joked about it, Koto is just using his popularity to sell the book. And in the end, that what matters. Numbers, sales, and profit. People should have saw this coming before raising all of these issues (Sashimi anyone?). I don’t think Danny himself is to be blamed. Whatever happens, this is work for him. Just that he should have known better than to be used like this.

    In the other hand, the really DOES show cosplayer as not who they really are. Normal people who picks up this book in the future might have a different impression of what cosplay really is, which is to dress up in your favourite anime/mango/game character and have fun in the process. As for the photographer’s copyright issue, interesting enough it was first raised in 4chan, of all places XD. In the end we took it for granted that the photographers have already given their consent to the cosplayers to use it for their submission in the first place. I know I did and I don’t really give a damn.

    But really, we don’t really have any control over this issue. As Dei, a cosplayer friend, said the other day, he don’t give a shit over this issue anymore. He sent his submission just for fun and it does not matter what happens after that. What we can do in the end is support our local cosplayer friends.

    In the other hand, I am talking with Animax/CF on releasing a photo book collection of local cosplayers for this year’s CF. If the plan gets the go ahead, I will contact all the photographers to submit what pictures do they think is the best. That’s the only thing that I can do to counter this issue.

    I’ll leave everyone to their own impression of DC and like I said, it’s not like I know that guy. I can only interpret based on what little time I have spent reading in DC and from other blogs about him. Which I am glad to say, isn’t much. Lol. I’m also too lazy to get into this discussion deeper. Since it was meant to be “just another bloggers’ troll post”.

    But back to the main issue at hand…

    Seeing exactly how DC is a “superpower”, isn’t it now more important to get things done right?

    If left unchecked this time, wouldn’t everyone be left in the dark if there was a second time, say Otacool 3? Maybe another cosplay book, by other parties even.
    Couldn’t he or Kotoblah use the first time (Otacool2) to force any future laws conflicts to be pass in their favor by throwing something along the lines of Judicial Consistency* on the table?

    *I’m actually not sure if “Judicial Consistency” is the right term to use.
    But what I’m trying to describe is how that since Otacool 2 was allowed to be published without any issues from the administrating authority, any future released can avoid scrutiny as well by using Otacool 2 as a guideline or reference.

    I remember a specific term for this scenario. Way back when I actually did a little studying in college. Study? zOMG??! Lol.

    Hmm… Should I take Otacool 1 into account? The submitted photographs are probably self-taken. So there’s probably no crediting issue there.

      Isn’t it possible to bring up the issue on the what-if Otacool 3 by bringing up Otacool 2? What I mean is, trying to use “ex-post facto” effects to counter “judicial consistency”.

    Honestly, I did just 1 semester on Australian Law and barely passed it. So I’d actually prefer someone with the right facts and knowledge to reply you. But stating from whatever left in my memories.

    Judicial parties do not go “ex-post facto” easily. And more often than not, this is only considered when cases involve serious criminal offenses.

    But the Wiki link above says a lot. Especially so, going through United Kingdom, United States, (in fact, most of the countries).

    I don’t particularly mind Danny’s face on the cover. As the sources of the book’s main publicity and marketing, I can understand his inclusion.

    What I think is a much larger issue is credit. There is nothing legally wrong with not including photographer and cosplayer, but it’s just bad taste. It’s not hard to include contributors, especially for a book like this.

    For something that is going to make profit, he should have really been very careful about this.
    It’s also a book featuring cosplayers not costumes… If anything, the cosplayer needs to be named.

    There has been some buzz about the copyright issue in dA as of late, and I think the buzz has reached Danny since he tweeted these recently:

    “Photographers will get a credit in Otacool2 but only got space for one name. But some folks want to credit their tailor and parents too…”

    @Hexlord Your turn to help me then – folks want to credit 10 or more photographers – what to do?

    Re Otacool2 – the koto leagal stuff just means that can use your pics for otacool2 promo posters – does not mean they own your photos. (泣)

    At the least, I guess DC isn’t letting people hang out to dry… but I think in a business perspective, the management of this project sucks… he should at least tell Koto to change the vauge wording in their legal mumbo jumbo… and say that the photos will only be used for OTACOOL 2 promotions only.
